Proposal for a short-term reform to strengthen municipal options for action in road traffic law

Abstract:

More and more municipalities are ready to strengthen environmentally friendly mobility or to distribute public space more equitably - for example by setting up bicycle lanes or traffic-calmed zones, by managing parking spaces or regulating sharing offers. But they are often hindered by federal road traffic law, which is heavily geared towards car traffic. This should only be restricted if there is a local danger. Reorganization of traffic therefore often requires complex verification procedures. In the current legal framework, it is not possible to conceptually redesign local mobility on a large scale.

Against this background, the Climate Neutrality Foundation and Agora Verkehrswende have commissioned the law firm Becker Büttner Held to conduct a legal opinion on the question of how road traffic law can be changed at short notice in such a way that the municipalities' options for implementing the mobility transition are strengthened.

In their joint proposal, Agora Verkehrswende and the Climate Neutrality Foundation summarize the arguments of the report and derive recommendations for action for politics.
